
The third issue of the international scientific and practical journal “Law and Digital Economy” was published in 2020.
The journal opens with an article by O.V. Kozhevina. “Development of blockchain technology in the context of ensuring digital growth of the economy.” Platform digital solutions are becoming a common attribute of managing companies, industries, and the economy as a whole. Ensuring digital growth is a key task set by the Government of the Russian Federation until 2024. It cannot be achieved by limiting the introduction of modern information and communication technologies into business processes and state (municipal) and regional management. The development of blockchain technology, the identification of its prospects, advantages and disadvantages when broadcasting to various sectors of the economy is relevant. The article discusses the use of blockchain technology in different areas of the economy, identifies the benefits and risks.
Of interest is the article “Artificial Intelligence in Corporate Law as a Virtual Assistant in Approving Extraordinary Transactions: A Look into the Future” by E.V. Zagrebayeva. The article analyzes the possibility of using artificial intelligence as a virtual assistant when making extraordinary transactions. The author notes that the development of information and computer technologies is largely due to public and private investments. Artificial intelligence can become a tool for making decisions with a faster reaction rate to an event. The article emphasizes that the purpose of artificial intelligence is to simplify human activities.
Article by D.V. Ponomareva and Barabasheva A.G. is devoted to patent protection of the results of scientific activity and artificial intelligence. The authors examine the approaches formulated by doctrine and practice in relation to objects created by robotic systems, computer technology and AI. The problem of the relationship between patent protection of the results of scientific (scientific and technical) activities and artificial intelligence systems is becoming more and more urgent.
Carrying out measures to identify clients using new digital technologies is the subject of research, stated in the article by I.E. Mikheeva. The article deals with the issues of customer identification using new modern technologies that make it possible for banks to take more effective measures to counter the legalization (laundering) of proceeds from crime. The author has analyzed the current Russian legislation and regulations of the Bank of Russia in terms of remote identification of clients – individuals for the implementation of certain banking operations. The article notes that the introduction of remote identification provides benefits for both banks and bank customers.
Darkina M.M. proposed an innovative topic for her research. In her article “The practice of using electronic digital signatures in business”, the problems of the practice of obtaining changes and the use of electronic signatures (ES) by entrepreneurs in their activities are considered, regulatory legal acts are indicated regulating the procedure for obtaining an electronic signature by the relevant persons and submitting the necessary documents to certification centers for its receipt, the types of electronic signature are indicated – simple and enhanced, the procedure for using a simple unqualified and enhanced qualified signature.
Article by P.V. Samolysov dedicated to the legal regulation of cryptocurrency mining. The legal vacuum in the regulation of mining acts as a serious inhibiting factor at the present stage of its improvement and often itself becomes an offense. At the same time, cryptocurrency mining is one of the new types of entrepreneurial activity, and therefore in the near future it is necessary to introduce state regulation of cryptocurrency mining in the Russian Federation. Important results of the study are the development of the problems posed, which for a long time remained outside the attention of specialists, as well as the significant novelty of the factual material introduced into circulation.
